• Faulty products

    Goods are classed as faulty if they are damaged in transit, or where a manufacturing fault occurs within a reasonable period from the time of purchase.

    Items that are damaged as a result of wear and tear are not considered to be faulty.

    If you think a product is faulty please contact us and we will assist you with organising to return the product.

    If the item is deemed faulty, we will either issue a refund for the purchase price or we can provide a replacement.

    Change of mind

    Sorry we don’t offer a refund if you change your mind.

    If you have concerns about a product you have purchased, please contact us first with your concerns and we can work with you to resolve the matter.

    5 Nine Designs is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

    We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The National Privacy Principal’s govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

    What is Personal Information and why do we collect it?

    Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, email addresses, phone and facsimile numbers.

    This Personal Information is obtained in many ways including by telephone, email, our website 5ninedesigns.com.au and from third parties. We don’t guarantee website links or policy of authorised third parties.

    We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

    When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

    Sensitive Information

However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

    5 Nine Designs will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

    In order to protect your Personal Information we may require identification from you before releasing the requested information.

    It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date.   • Our sculptures and artworks are made from durable mild steel, but even steel needs a little care at times.

    In a raw steel form mild steel will continue to rust slowly over time and will last for many years in it’s natural raw state. How quickly a sculpture or artwork will rust will depend on the environment and whether the sculpture or artwork is placed, inside or outside.

    Many of our sculptures and artworks will come with a protective coating. This coating is a product called Penetrol. Penetrol is a oil based sealing product that helps lock in the rustic patina and seals the steel from the elements. Sculptures or artworks coated in Penetrol should maintain their look for many years however if stored in the elements a touch up coat of Penetrol can be applied when needed.

    Penetrol can be purchased at most leading paint and hardware stores.

    If you have purchased a product in raw steel and would like to lock in the raw steel or rustic patina this can be achieved by coating the product with Penetrol. Allow at least 24hrs for the Penetrol to fully penetrate into the steel before hanging on any internal walls or surfaces that are likely to mark.

    We keep many of our products in stock and when ordered these are usually dispatched within 2-3 business days.

    Out of stock

    Where we are out of stock we will endeavour to create the item and have it dispatched within 7 business days.

    Custom orders

    Dispatch time for custom orders will be discussed as part of the consultation process in creating your custom order.

    General

    In general if we predict there is going to be a delay in dispatching a purchased product, we will contact you to advise and discuss.

  • For most of our items the postage is a flat rate.

    We post within Australia, but do not post internationally.

    We do our best to keep our prices low, but costs are costs. We would love to offer free postage but to do this we would have to put our product prices up to accommodate the postage so free postage really wouldn’t be free.

  • Most of our products are presented in a rustic patina. On some items this rustic patina is allowed to develop to generate unique rustic colours and patterns.

    Importantly the colour of the products depicted on our website are for illistration purposes only. Each product is individual and uniquie in it’s own right, and the colour will vary from one product to the next.
